1. Agreement
These Terms of Service are between Build Daily, LLC ("Build Daily," "we," or "us") and each person or organization that visits, subscribes to, or uses Build Daily. By creating an account, accepting an invitation, completing checkout, signing an order form, or using the services, you accept these terms.
2. Services and authorized use
Build Daily provides contractor operations software for estimating, projects, service, dispatch, documents, files, time, manpower, billing workflows, portals, and related work. You may use the services only for legitimate business purposes you are authorized to perform and in compliance with applicable law.
3. Accounts and security
You are responsible for accurate account information, safeguarding credentials, managing user permissions, and activity performed through your account. Do not share passwords, bypass access controls, impersonate another person, or access data you are not authorized to view. Notify Build Daily promptly if you believe an account has been compromised.
4. Subscriptions and payment
Subscription fees, billing intervals, user limits, and enabled modules are controlled by the applicable checkout, order, or subscription configuration. Fees are due as shown at checkout or on an invoice. Unless required by law or expressly stated otherwise, fees are non-refundable after a billing period starts. Access may be suspended for overdue amounts after reasonable notice.
5. Customer data and privacy
Customers retain ownership of the records, files, communications, and other content they submit. Build Daily receives the limited rights needed to host, process, secure, display, transmit, back up, and support that data while providing the services. Personal information is handled under our Privacy Policy.
6. Electronic signatures and retained evidence
When a user signs, approves, acknowledges, or completes a document through Build Daily, the electronic action is intended to have the same effect as a handwritten signature or approval to the extent permitted by law. Build Daily may retain completed documents and related consent, identity, delivery, timestamp, audit, and integrity evidence for seven years after completion, or longer when required by law, contract, dispute, investigation, or legal hold.
7. Prohibited conduct
You may not use Build Daily for unlawful, abusive, infringing, deceptive, or malicious activity; upload malware; send spam or phishing; falsify time, location, safety, service, or project records; scrape or reverse engineer the services except through documented interfaces; bypass security or billing controls; or interfere with platform reliability.
8. Intellectual property
Build Daily, LLC owns the Build Daily software, website, product design, workflows, trademarks, documentation, and related intellectual property. These terms provide only a limited right to use the services while access is authorized. Customer data remains the customer's property.
9. Automation and professional responsibility
Build Daily may provide automated summaries, analytics, suggestions, notifications, or workflow assistance. These features are informational aids. Users remain responsible for professional judgment and for legal, accounting, employment, payroll, tax, safety, engineering, project, and contractual obligations.
10. Suspension and termination
Access may be suspended or terminated to protect security, enforce these terms, respond to nonpayment, comply with law, or address a material breach. After termination, access may end and an organization may request an available data export for a limited period, subject to identity, authority, security, retention, and legal-hold controls.
11. Warranty disclaimer
The services are provided "as is" and "as available." To the maximum extent allowed by law, Build Daily disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent allowed by law, Build Daily is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. For an organization, Build Daily's aggregate liability for claims related to the services is limited to fees paid for the services during the 12 months before the event giving rise to the claim. For an individual user without a direct paid subscription, total liability is limited to $100.
13. Governing law
These terms are governed by New Jersey law, excluding conflict-of-law rules. Disputes will be handled in state or federal courts located in New Jersey unless applicable law requires otherwise or the parties agree otherwise in writing.
